It is still against the law for someone to possess anything with a controlled substance. Some states like Illinois and Minnesota have statutes that specifically make possession of a controlled substance a felony.
The real problem with possession of a controlled substance is that it does not just happen in a state where it is a misdemeanor, it happens in a state where it is a felony.
In many states like Ohio, possession of a controlled substance is a felony. In one state, it is a misdemeanor. It’s not a problem for the person who is breaking the law. If you are going to be breaking the law, you should be getting a misdemeanor, but no one needs to know that. You should also be aware that a person who has the power to make a crime a felony is capable of obtaining a conviction on a misdemeanor charge.
I know that people have been arrested for possession of a controlled substance in Ohio for a very long time. In the early days of the police state, a conviction was a misdemeanor so a person couldn’t use possession of a controlled substance as an excuse for not following the rules. Now though, possession of a controlled substance is a misdemeanor and it’s really not a problem what you’re doing.
Thats because possession of a controlled substance is not a crime unless you’re under the age of 18. In other words, you cant use it as an excuse to ignore the laws. Also, its a misdemeanor to have it, so if you think youre in possession of something, you’re probably wrong.
The first rule I posted about whether possession of a controlled substance is a crime is: it’s a crime to have it. It’s not a crime to do anything illegal, just to get yourself into trouble. So, in my mind, possession of a controlled substance is a crime.
